OFFCIAL CONTEST RULES
Program Name: API HAIKU CONTEST
No Purchase Necessary. A Purchase Or Payment Will Not Increase Your Chances Of Winning. Void where prohibited or restricted by law.
The API Haiku Contest (“Contest”) is open only to individuals who (a) are legal residents of the fifty (50) United States and the District of Columbia, (b) have reached the age of majority in their state of residence at the time of entry and (c) have an account on www.twitter.com. Employees of Intel Corporation (“Sponsor”) and its parent companies, affiliates, subsidiaries, distributors, advertising and promotion agencies and members of the immediate family (defined as spouse, parent, sibling, child and respective spouses regardless of where they reside) and/or those living in the same household of such employees are NOT ELIGIBLE to enter. Intel Services Division LLC and Mashery, Inc. are subsidiaries of Sponsor.
2. How to Enter
The Contest will be open during the period from Monday August 18, 2014 at 12:00 am Pacific Daylight Time through Monday, August 18, 2014 at 5:00 pm Pacific Daylight Time (the “Contest Period”). During the Contest Period, from your Twitter account, tweet any haiku about application programming interfaces (APIs) with the #apihaiku hashtag and @Mashery username (“Tweets”). A haiku is a one-line poem consisting of three phrases containing 5, 7 and 5 syllables respectively. Tweets may still be considered an entry if the haiku format is not followed exactly. BY TWEETING THE SPECIFIED HASHTAG, YOU AGREE TO THESE OFFICIAL RULES. (Note: you will need to create a Twitter account if you don’t already have one. Membership on Twitter is free and registration for Twitter can be obtained by logging on to http://twitter.com and following onscreen instructions to open an account.) You should follow @Mashery on Twitter at http://twitter.com/Mashery to see if you won (pending verification) in addition to the notification process set forth in paragraph 3 below. Please note that if you do not respond as described in paragraph 3 below, you will be disqualified and an alternate winner may be selected.
Participants may submit multiple entries but may not submit multiple duplicate entries. Participants making multiple entries are only eligible for one prize. All entries must be received during the Contest Period to be eligible. Sponsor’s clock is the official time clock for the Contest.
3. Winner Selection
Winner(s) will be selected based on creativity, originality and relevance to APIs by representatives of Sponsor. These decisions are final and binding regarding all aspects of the Contest.
4. Winner Notification
Sponsor will make one (1) attempt over a twenty-four hour period following the selection of winners via the winning entrant’s Twitter account and tweets from @Mashery. If the potential winner does not respond within twenty-four hours of being contacted, the potential winner will be disqualified and an alternate winner will be selected from among the remaining valid entries. This process will be repeated until all potential winners respond.
5. Prizes/Retail Value and Odds of Winning
One (1) Grand Prize: a $75 Amazon.com Gift Card, approximate retail value (“ARV”) $75.00 and a t-shirt and swag collection from Mashery, ARV $20.00, one (1) First Prize: a $50 Amazon.com Gift Card, ARV $50.00 and a t-shirt and swag collection from Mashery, ARV $20.00 and one (1) Second Prize: a $25 Amazon.com Gift Card, ARV $25.00 and a t-shirt and swag collection from Mashery, ARV $20.00. Odds of winning depend on the total number of eligible entries received.
Prize consists of only those items specifically listed as part of the prize. All prizes are awarded “as is” with no warranties, representations or guarantees, including but not limited to, quality, condition, merchantability or fitness for a particular purpose. Winners must look to the manufacturer for any warranties or guarantees. No transfer or substitution of prizes, except by Sponsor in the event an advertised prize is not available. In such cases, Sponsor may substitute a prize of equal or greater value. Taxes on prize are the sole responsibility of the winners.
Sponsor does not claim ownership of your submission to the contest; but by submitting an entry, you are granting Sponsor and its affiliated companies the following worldwide, non-exclusive, perpetual, irrevocable, royalty-free, unconditional, fully paid-up rights: (1) to make, have made, use, copy, reproduce, modify, and create derivative works of the contributions, (2) to publicly perform or display, import, broadcast, transmit, distribute (directly and indirectly through multiple tiers), license, offer to sell and sell, rent, lease, or lend copies of the contributions (and derivative works thereof), (3) to sublicense to third parties the foregoing rights, including the right to sublicense to further third parties, and (4) to publish your name or alias in connection with this Contest and your contributions. By submitting an entry, you warrant that you: (a) own or otherwise have all rights necessary for the submission including any and all IP rights and you do not disclose any information which would constitute a violation of a confidentiality obligation; (b) your submission does not contain any viruses, worms, spy ware, or other components or instructions that are malicious, deceptive, or designed to limit or harm the functionality of a computer; and (c) your contributions are not subject to license terms that require any software or documentation incorporating or being derived from your contributions to be licensed to others.
Entries using macro, robotic, script or other forms of automatic entry will be disqualified. No mechanically reproduced entries permitted. Proof of submission does not constitute proof of receipt. Sponsor is not responsible for lost, late, mutilated, misdirected, incomplete, inaccurate or postage due entries. In the event of a dispute over who submitted a winning online entry, the authorized subscriber of the Twitter account used to participate in the Contest at the actual time of entry will be deemed to be the entrant. The authorized account subscriber is defined as the natural person who is assigned a Twitter account by Twitter.
8. Electronic Transmissions
Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsors further reserve the right to disqualify any individual who tampers with the entry process. Sponsor may prohibit an entrant from participating in the Contest if it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law.
9. Conditions Of Participation
Intel is committed to compliance with all applicable laws, regulations, policies and ethics rules. This notice is intended to ensure that your participation in this Contest will not violate any such laws, regulations, policies or rules. Intel seeks no promises or favoritism for itself or any of its affiliates in exchange for the opportunity to participate in the Contest. By entering the Contest, (i) you agree that your participation in the Contest – including your acceptance of any potential prize – will not violate any law, regulation, policy or rule of your country, state or government agency; and (ii) you certify that any potential prize is not in exchange for an agreement to influence a recent, pending or anticipated act or decision that may result in Intel obtaining or retaining business or a business advantage.
10. Mobile Phone Use
If you opt to use Twitter via your wireless mobile device (which may only be available via participating wireless carriers and is not required to enter the Contest), standard text messaging and/or data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Contest. Participation in this Contest by mobile device means that you understand that you may receive additional messages by mobile device relating to this Contest, including notifying you if you are a Winner, which may be subject to charges pursuant to your carrier's rate plan. Text messaging may not be available from all mobile phone service carriers and handset models. Mobile device service may not be available in all areas. Check your phone’s capabilities for specific instructions.
11. Disputes/Choice Of Law
Except where prohibited, each participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Delaware, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. Delaware law governs the Contest and all aspects related thereto.
